Under the Registration Act 1908, a lease deed for a period exceeding 11 months must be compulsorily registered at the Sub-Registrar's office. This registration involves stamp duty, registration fees, and a visit to the Sub-Registrar's office — time and money that many landlords prefer to avoid.

By keeping the lease at exactly 11 months, landlords avoid this mandatory Sub-Registrar registration. This is a legitimate legal strategy, not a loophole — the law explicitly draws the line at 11 months.

Is an 11-Month Agreement Legally Valid?

Yes, absolutely. An 11-month rental agreement is a fully valid legal contract. It is enforceable in court. The only difference from a registered lease is that it cannot be used as primary evidence in certain property disputes — but it is still admissible as secondary evidence and is sufficient for most practical purposes.

Tamil Nadu: The Extra Requirement

In Tamil Nadu, there is an additional requirement that most people miss. The TN Tenancy Act 2017 requires Rent Authority registration for ALL tenancy agreements — including 11-month ones. This is separate from Sub-Registrar registration and is done online at tenancy.tn.gov.in.

So in Tamil Nadu, an 11-month agreement still requires Rent Authority registration. What it avoids is only the Sub-Registrar registration.

Does It Avoid Stamp Duty?

No. Stamp duty is payable on all rental agreements regardless of duration. In Tamil Nadu, it is 1% of the aggregate amount (total rent + deposit). Skipping stamp duty makes the agreement inadmissible as evidence in court.
