Understanding Rental Agreement Registration in Tamil Nadu

If you are renting a property in Tamil Nadu, you need to understand that registration is not a single process — it is two separate legal requirements under two different laws. Confusing them is one of the most common mistakes landlords and tenants make.

Track 1: Rent Authority Registration (Mandatory for All)

The Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act 2017 (commonly called the TN Tenancy Act) requires that every tenancy agreement — regardless of duration — be registered with the Rent Authority. This is a separate authority from the Sub-Registrar's office.

The registration is done online at tenancy.tn.gov.in. There is currently no prescribed government fee for this registration. A service charge of ₹100 is typically charged by service providers who assist with the filing.

Why does this matter? Because Rent Authority registration gives you access to the Rent Court — the dedicated tribunal for landlord-tenant disputes in Tamil Nadu. Without registration, you cannot file a complaint under the TN Tenancy Act.

Track 2: Sub-Registrar Registration (Only for Leases Over 11 Months)

Under the Registration Act 1908, a lease deed for a period exceeding 11 months must be registered at the Sub-Registrar's office. This is the traditional stamp-and-register process most people are familiar with.

For leases of 11 months or less, Sub-Registrar registration is not legally required. However, it is optional and does improve enforceability — a registered document is harder to dispute in court than an unregistered one.

What About Stamp Duty?

Stamp duty is payable regardless of whether you register at the Sub-Registrar's office. Under Article 35 of the Tamil Nadu Stamp Act, stamp duty is 1% of the aggregate rent payable (total rent for the period + deposit/advance). This is a government charge and goes directly to the state — not to any service provider.

Practical Summary

11 months or less:Rent Authority registration required. Sub-Registrar registration optional. Stamp duty payable.
Over 11 months:Both Rent Authority AND Sub-Registrar registration required. Stamp duty payable.

Practical tip: Always complete Rent Authority registration within 90 days of executing the agreement. Late registration may attract a penalty.
